Tiny Town 5K
Participant & Volunteer Liability Waiver and Release
IN CONSIDERATION FOR BEING PERMITTED TO PARTICIPATE as a runner, volunteer, spectator, or participant in the Tiny Town 5K and related activities (the “Event”), I, on behalf of myself and my representatives, administrators, executors, assigns, heirs, and any minor or other person for whom I am legally responsible (collectively, the “Releasing Parties”), agree as follows:
1. Assumption of Risk
I understand that participation in a road race, fun run, or related activities involves inherent risks. These risks may include, but are not limited to:
Falls
Contact with other participants or spectators
Traffic and road hazards
Weather conditions including heat, cold, rain, or lightning
Uneven terrain or course conditions
Dehydration or illness
Exposure to communicable diseases
Injury, disability, or death
I acknowledge that the Event may take place on public roads, parks, sidewalks, trails, or other public or private property, and that these conditions may present risks that cannot be fully eliminated.
I voluntarily assume all risks associated with my participation in the Event.
2. Release of Liability
I hereby release, waive, discharge, and covenant not to sue Tiny Town 5K, its organizers, directors, staff, volunteers, sponsors, partners, vendors, and affiliates (collectively, the “Releasees”) from any and all claims, liabilities, damages, losses, or expenses arising out of or related to my participation in the Event, including claims arising from the negligence of the Releasees, to the fullest extent permitted by law.
3. Indemnification
I agree to defend, indemnify, and hold harmless the Releasees from any loss, liability, damage, or costs that may arise from my participation in the Event or from claims brought by others on my behalf.
4. Health and Fitness
I certify that:
I am physically able to safely participate in the Event.
I have not been advised by a medical professional not to participate.
I will follow all safety instructions and Event rules.
I acknowledge that medical assistance may be limited during the Event and that I am responsible for my own medical expenses if treatment is required.
5. Event Rules and Removal
I agree to follow all rules, policies, and instructions given by the Event organizers or volunteers.
Event organizers reserve the right to remove any participant who:
Poses a safety risk
Violates Event rules
Engages in disruptive behavior
6. Event Changes or Cancellation
I acknowledge that the Event may be cancelled, postponed, or modified due to circumstances including but not limited to weather, safety concerns, public health issues, government orders, or other unforeseen events.
I understand that registration fees may be non-refundable if the Event is cancelled or modified.
7. Media Release
I grant permission to Tiny Town 5K and its partners to use photographs, video, or recordings taken during the Event that may include my image, likeness, or voice for promotional, marketing, or educational purposes without compensation.
8. Personal Data
I understand that information provided during registration may be used for Event administration, race timing, and publishing race results.
9. Minors
If registering a minor under the age of 18, I certify that I am the parent or legal guardian and agree to all terms of this waiver on their behalf.
10. Severability
If any portion of this waiver is found invalid or unenforceable under the laws of North Carolina, the remaining provisions shall remain in full force and effect.
11. Acknowledgment
I certify that:
I am 18 years of age or older, or a parent/guardian signing for a minor.
I have read and understand this waiver.
I voluntarily agree to its terms.
